49cc scooter license in Florida: what you need
In Florida a 49cc scooter counts as a moped: an ordinary driver's license is enough, no motorcycle endorsement. Age, helmet and where you can ride, and the rules for e-bikes.
Do you need a license for a 49cc scooter in Florida?
Yes, but not a motorcycle license. In Florida a 49cc scooter that cannot go faster than 30 mph counts as a moped, and an ordinary driver's license is enough to ride one: no motorcycle endorsement.
To rent a 49cc scooter from us you need a valid driver's license you have held for a year, and you must be 18 or older. A Class 2 e-bike needs no license at all.
A plain summary of the Florida rules as we apply them, checked in October 2026; it is not legal advice.
The rules in plain words
- Do I need a motorcycle endorsement for a 49cc scooter?
- No. In Florida a moped needs a valid driver's license of any class; an ordinary car license (Class E) is enough.
- Can I ride with a license from another country?
- Florida lets visitors drive on a valid license from their own country. If it is not in English, bring an International Driving Permit with it. We check your license at pick-up.
- How old do I have to be?
- Florida allows mopeds from 16, but to rent from us you must be 18 or older, for the scooter and for the e-bike.
- Do I have to wear a helmet?
- Florida law requires one under 16. Our rental agreement requires every rider to wear a helmet, whatever their age.
- Where can I ride a 49cc scooter?
- On ordinary roads, keeping to the right when traffic is faster than you. Not on interstates or expressways (I-95, I-395, SR 836 and the like), and never on the sidewalk.
- Do I need a license for an e-bike?
- No. A Class 2 e-bike, whose motor helps up to 20 mph, is treated like a bicycle in Florida: no license and no registration. You still must be 18 or older to rent one from us.
- Is the scooter registered?
- Yes. Every scooter carries its Florida tag and registration; keep the papers with it.
- Can I ride after a drink?
- No. Florida's DUI law applies to mopeds as it does to cars: the limit is 0.08%, and 0.02% under 21.
